Following the EU's confirmation that it will implement the recommendations of the DSU in DS397 - Steel Fasteners from China, the EU has published amendments to the Basic Regulation which take effect as of today, 6 September 2012.
Of particular importance is the change in the burden of proof on Chinese producers to claim IT (individual treatment). Whereas before it was each producer to demonstrate that it met the criteria for IT, henceforth in all new investigations it will be for the Commission to show that IT is not justified.
