EU UPDATE: Competition Law Compliance

The UK National competition authority - The Office of Fair Trading (OFT) - has published on its website (here) a number of new competition guidance notices for companies doing business in the UK. Although these are geared specifically to the UK market, they concern matters of general application across the EU and can therefore be a valuable resource for all EU compliance programmes.

An example of this is the useful basic visual representation below, which sets out the four step Competition Compliance Process it recommends companies follow to tackle the specific competition law risks they may face.

The OFT position is that effective compliance is driven from the top down where it is visibly supported by managers at all levels of the business who demonstrate a commitment to complying with the law.
