EU UPDATE: Competition Law - Dawn Raids

The EU Commission's anti-trust officials accompanied by their national counterparts carried out simultaneous dawn raids on Tuesday morning (27/09/2011) across the EU.  The number of locations reported to have been raided makes this one of DG COMP's largest dawn raid operations to date.

Anti-trust Anti-trust officials apparently raided the offices of 21 companies in 10 EU Member States with the focus of the raids being the market practices of Russia's Gazprom.

Commission Investigators are entitled to gather both electronic and physical evidence to pursue their investigations into any alleged anti-competitive conduct.

Given the nature of the EU market for gas, the current investigation will likely raises issues of compliance with both Article 101 (horizontal/vertical agreements) and 102 (abuse of dominance) of the TFEU.
