The European Commission Suspends Anti-Dumping Duties on Aluminum Flat Rolled Products From China

On 11 October 2021 the European Commission published a Regulation imposing a definitive anti-dumping duty on imports of aluminum flat rolled products originating in the People's Republic of China; but at the same time adopted a Decision suspending the duties in question.

The suspension decision is the result of a long legal battle conducted by Airoldi Metalli Spa who was represented jointly by the law firms: Grayston & Company in Brussels and Campa Avvocati based in Lecco and Milan. The Grayston & Company team was led by Davide Rovetta, who worked with Laura Carola Beretta, Vincenzo Villante and Kenneth Davies. For Campa Avvocati, Massimo Campa led the team with Marina Pirovano and Linda Gatti.

Resorting to a suspension decision is a rarely used procedure for the European Commission, as it amounts in effect to a decision to impose and then not to impose measures. As far as we are aware this is the first time a suspension measure has been applied in such circumstances since before 2010.

The suspension of the EU anti dumping measures at issue represents a significant victory for Airoldi Metalli Spa and its long held position that the EU Commission should not continue imposing anti-dumping duties on these critical industrial products in the current exceptional market situation.
